In some areas it's actually legal for women to go topless. Where I live (Vancouver, Canada) there were protests back during the 90's where women would walk topless down the street to fight for the 'right' to be topless if they wanted it.

Indecent exposure, lewd conduct, public indecency or whatever the charge may be, I just want to know the definitive answer to this.

You won't probably arrest you BUT this what WILL happen should you do it enough to get on the police radar. They will bring you in to lock-up for 24 hours and then decide, no we don't want to press charges. Lock up is worse than jail, it's a tank with other people in it and you have to ask for every little thing and it is really unpleasant.

They will have witness accounts and therefore evidence which means they can hold you for a certain time without pressing charges.

However, if they are really mean they will pick you up on a Friday and you will spend 48 hours in the tank until somebody decides that it isn't worth pressing charges.

A lawyer will be able to get you out with a writ of Habeus Corpus before those times are up, but it's going to cost you and you will do some time and sometimes lawyers aren't all that swift to act either.

If you continue after being in the tank once, you will be charged. You won't get anything but time served and a fine and a large legal bill from a lawyer and a record that you have been arrested and convicted for indecent exposure where every prospective employer will be able to see it forever.

1) It is a misdemeanor

2) Indecency laws have been found to be constitutional, so yes the law has been challenged, but it was upheld.

What some people think it was not upheld because the Superior Court (not the Supreme Court) ruled that one law in one community did not define what constituted indecent exposure and therefore that law was struck down on those grounds. Enough time has passed for most communities to make those definitions.

Answer to Question: I'm a former reporter and while you could be charged, but there are degrees of indecent exposure. I'm not a lawyer, but the odds are very low you will be charged and tried for "flashing". But there are levels of indecency and there is a line that you can cross where you will be charged.
